Terms of Service

1. About these terms

These terms apply to every order placed on the Ember Living website. Please read them before placing an order. By placing an order, you agree to these terms. Our contact details are set out in our Contact Information policy.

These terms do not affect your statutory rights as a consumer.

2. Products

We try to show our products as accurately as possible. Images are for illustration, and colours, textures and finishes may vary slightly between screens and between individual pieces. Sizes and measurements are approximate.

3. Prices and payment

Our prices are in pounds sterling (£). The amount you will be charged is shown at checkout before you pay.

UK delivery is free on every order. We currently deliver to UK addresses only, as explained in our Shipping Policy. Payment is taken securely at checkout when you place your order.

If we discover that a product has been listed at the wrong price, we will contact you before dispatching your order to ask whether you would like to continue at the correct price or cancel for a full refund.

4. Your order

When you place an order, you will receive an email confirming that we have received it. This is not acceptance of your order. A contract between you and us is formed when we email you to confirm that your order has been dispatched.

We may decline or cancel an order, for example if a product is unavailable or there is an error in pricing or the product description. If this happens, we will let you know and refund any payment in full.

5. Delivery

Delivery details and estimated times are set out in our Shipping Policy and on each product page. Delivery times are estimates and are not guaranteed.

6. Returns, cancellations and faulty items

Your right to cancel, how to return items and how refunds work are set out in our Refund Policy. If an item is faulty or not as described, you have rights under the Consumer Rights Act 2015.

7. Discount codes

Discount codes are subject to any conditions stated with them, can only be used once per customer unless stated otherwise, cannot be exchanged for cash and cannot be applied to orders that have already been placed. We may withdraw a discount code at any time.

8. Our responsibility to you

If we fail to meet these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure. We are not responsible for loss or damage that is not foreseeable. We supply products for domestic and private use only, and we are not liable to you for any loss of profit, loss of business or business interruption.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

9. Using our website

All content on this website, including text, images and design, belongs to Ember Living or is used with permission, and may not be copied or reused without our written consent.

10. Your personal information

We only use your personal information as set out in our Privacy Policy.

11. Changes to these terms

We may update these terms from time to time. The terms that apply to your order are those shown on our website at the time you place it.

12. Governing law

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of your home country.
